Hello all fo you!! update iin my Brother embroidery machine I bought in Ebay. I have to say Ebay is been fair and the resolution was on my favor. they told me that they will refund my money either way. My problem is the seller, he has already sent two e mail harassing me and threaten to court. this is a nightmare. !!!!! I call Ebay they told me not to pay attention to his e mail. still is very scary situation. In the first email he accused me of a scammer and he is coming to Orlando next month and will bring me back the useless machine I sent back I went to UPS paid 40 dollars to be packed professionally and took pictures while they were packing each piece in bubble plastic and peanuts. I spent all that money because I had the feeling he was going to do something like that. Some things that he did not do. the machine came with very little peanuts and the pieces everywhere. I have to confess I am very nervous about this man. Well I think he is a man. I told Ebay they shoud not allowed this person to be part of ebay anymore. Ebay advice me to make a police report. I am afraid of making him more adset. I do not want to get into any legal process. Never been in a court just for jury duty. I pray to God this nightmare will end soon.

Now I can say everything is 100% good. /the money was returned to the credit card yesterday. And the seller stopped his emails. I really do not understand his attitude. He knew Ebay has 100% satisfaction policy. so Why did he do it? Why did he get so nasty he did not make a profit but did not loose any thing he got his machine back. I have to start looking for a machine.

Mary, Your comment in one of the other posts stating that eBay did not have an email messaging, would be one of the reasons that eBay stresses to keep communication through their eBay messaging system so that they can access any of the messages, if there ever is a problem as they could see the communication and know that there had not been anything altered, along with they can take care of things quickly when they are not needing to wait on getting those email messages printed off and sent to them, for them to continue to address an ongoing problem. Sellers can get into trouble with eBay if they are luring people to email rather than using the eBay messaging system. This person likely knew this, and had you take the communication through email, where it sounds you did not understand just why that could cause a concern for you. That seller likely feels that what is being said through their email would not get them in trouble with eBay, or that you will not file a police report against them, or send those emails to eBay. The intimidation they are trying on you, IS going to get them in trouble. PLEASE do send those emails to eBay and PLEASE do make a police report. This person would most definitely be called on the carpet by both the police and by eBay. This really is not something that you need to worry about progressing past a police report, because the police will tell that seller to knock it off and to not show up on your doorstep. You said you do not want to make the person even more upset. I and all the Cutie's here along with eBay and the police want YOU to be safe. When the seller is bringing all this on themselves for their own conduct, we all do not care what they want or like, we want above board legal transactions not threatening and harassment by sellers to get their way. That seller likely will not want to get the police involved. Just make copies of all your messages and of all the UPS pictures and receipts and take them to your local police station. Since Orlando is a larger area, you may want to call the police business line on Monday- NOT the 911 line, and see when would be the best time for you to bring in your paperwork to make that report. Stress the points Dennis made in his post about your health etc. Likely the police would have you come in during the Monday through Friday work week and during the time that the officer who is over this type of situation is scheduled to be working. If you have difficulty getting around, then the police may even be able to send the officer to your house to take the report. Now if you do not make that report, then you possibly may have that person show up on your doorstep, though I also doubt that they would bring this machine back to you, they are just trying to make you afraid or want you intimidated enough that you give in to them, and since you have already been validated by eBay and you are not willing to accept the junk machine they sent you, that only leaves that they are trying to frighten you. Showing up on your doorstep would not lead you to give them any money, so this is solely to try to scare or intimidate you. They will not take you to small claims as they would have to pay filing fees to do so, and with eBay already siding with you, then they would be guaranteed to loose. Having a police report filed also will be in your favor in the unlikely event that this person does anything else. The seller is just mad that they did not get away with their own scam against you. This kind of hassle is why many people just chalk up situations like this to being a lesson learned. It can be very stressful. It is sad that people often are not willing to go through the hassle and would rather loose their hard earned money and get some junk rather than to hold a seller accountable. I am glad you allowed eBay to evaluate this situation, it is just a risk when you have to agree to eBay's arbitration of the situation. Thankfully now, you will be reimbursed. Hopefully all this has not soured you toward making other purchases through eBay and PayPal, just evaluate each site thoroughly. There are still good businesses there also, but there are also too many on line who sell stolen merchandise, which may be another reason that this seller may not want to draw any attention from a police officer. EBay has backed you. When the emails of their threats against you are seen by eBay they will likely loose their eBay selling privileges or at the minimum be put on probation and have limited selling privileges, which was what happened to a seller I had problems with several years ago as they were limited to just 4 items for sale at one time, once the seller in my case had additional problems with another buyer, they were fully cut off from selling through eBay. If you can still edit your feedback for the machine you can put in the threats they have done to you. This type of review will cost them dearly, as there will be far less people willing to do even the smallest of business with them, that is IF they are even allowed to keep any of their selling privileges. If you state in that review that per eBay's advice you will be making a police report, sending in their emails to eBay and that any further email contact will not be read by you, but be forwarded to the police officer that will be over the police report, that seller would have to be off his rocker to push things even farther than he already has! I do hope that since you won the judgment from eBay that it should be very soon as to when you get your reimbursement. In my case it was within a day or two max, though my situation was far less money than your sewing machine. Once you have your money back, then you can put this all behind you, as long as you do make that police report so that you would be reassured that the seller would not be showing up on your doorstep. If after making that police report the seller STILL showed up, then I would have to agree with bevintex that the seller must have a mental imbalance, but I hope that you will have no further contact with them and you will hopefully be telling us of your new machine next week, that is my hope for you anyway. Mary, every Cutie who has responded to your situation update has given you the most perfect advice covering each aspect of the issues you have reported. Copy all documentation from this idiot seller as well as the documents from UPS to EBay and insist that they intervene with action against this person. Since the seller has taken delivery of the returned machine for which you have paid a lot of money to have professionally packaged and shipped, I do not understand why EBay has not refunded you in full under the terms of their guarantee policy.
Report this entire matter to your local police and support your statement to them with copies of all documents and associated correspondence. Stress upon the police your concerns regarding the impact that this is having on your health and that the seller is threatening to visit you. In the circumstances, the police should take action in association with EBay to bring the seller to book! As much as I understand your personal concerns, reporting all of this to the police at the earliest will provide you with some comfort. I know that this is little comfort to you now but you must learn from this experience and ensure that if you must deal with the likes of EBay and similar organisations that you follow the advice that many have given you in your earlier posts. For example, I don't understand why you have dealt with this seller and yet still cannot be certain as to his/her gender. I wish you well in resolving this matter speedily and that the idiot seller recognises that they are getting themselves into very hot water and does the decent thing.

Thank you I will file a police report making copies of all his email including the first one he sis not want to accept the machine back. then he changed his mind. I sent copies of his last two email those are the one he is threatened and harassing me. accusing me of a scammer !!!!!!!

Definitely let the Police know what he has done and that you don't feel safe, take a copy of your photo's and the emails with you if anything needs to be done the Police will need them. Hopefully this twit has let off steam and will leave you alone. His behaviour is unacceptable. Marian

What a horrible experience you are having with this seller. Definitely report the Emails to the Police stating that you feel threatened as he knows your address.
These type of horrible people are usually all talk and no action but better safe than sorry. We not long ago had one such person move in next door for a year and made our life hell with threats. Nothing did happen but our nerves suffered.
The horrible experience will pass just doesn't feel like it at the time.

Take the advice from eBay and call your local authorities. One never knows if these few emails are the legal "straw to break the camels back" I am sure you cannot be the first to return something he sent. Perhaps they know something about him that they cannot share. Even if this is his first time to threaten someone -- your local authorities should be notified.
KEEP the emails! Never delete them without the advice of an attorney. They will not take up much space and they are worth saving for your safety or the next customer. You can forward them (get someone to help you) if needed. Forwarding does not delete the email.

I think he is trying to intimidate and scare you. I can't imagine he would go through court costs to make you take a machine that is clearly junk. It has been resolved by ebay and it is over. Do not hesitate to contact police if he comes to your home. I do believe he may be mentally unstable

Thanks for the update Mary. I'm delighted that you will get your money back. Please ignore the emails the seller is sending but forwards them to ebay. Many of Cuties have suggested that you buy from a dealer, mant dealers offer monthly payment schemes and have excellent machines they have taken in part exchange. I'm so sorry that you have had the problems you have had but again thanks for letting all of us know what is happening.

I am planning to go to a Brothers dealer but until I do not see my money back I can not do anything. The closest dealer is in a town around an hour from Orlando. It is very scary situation.

If you have a printer you could print them off and send one copy via us mail to ebay Save one copy just in case you have to call the police---don't be afraid of the police, they are there to help you and are generally very kind and helpful to seniors.
