Unfortunately I think it is mainly the digitizing. I have noticed recently a lot of people buying software and immediately setting themselves up as digitizers. From the questions they are asking on the software forums it is clear they haven't got even the basic knowledge of customizing designs let alone digitizing.
I fear this may be true. I'm more careful now about what I buy. If I do buy from a new site, I make a small purchase and look at it to see what underlay it has, how many jump stitches, etc.
I am sticking to the tried and true digitizers. If there is a particular design that appeals from a new site I check out the feedback before purchasing.
If it is the digitizing, you should be able to tell by stitching the design out before you try to resize it...also, it could be that you have not stabilized the design enough for the number of stitches in the design...could be several things...but before I would ask the digitizer to do it again, I would stitch it out before you change it and make sure you stabilize correctly for the fabric you are using...

I don't think you are doing anything wrong. I think there is a problem with the digitizing as you said below. Hope you post a picture of what the second attempt looks like.
What kind of fill stitch is that for the white body? There is a gap between the outline and body on both ends, correct?
While I have never had this problem personally, it looks a little like fabric is being pulled together from the stitches. Did you change any of the pull adjustment settings in Embird?

So, just had this problem myself the other day with a custom design. The problem was, that all stitches in the design had the same orientation (in my case left to right / right to left), which caused a lot of stress on the fabric.
The solution was to change the orientation of some of the areas.
Example:
- First attempt, fabric being pulled:

Notice how the fill areas have been rotated in the second image.
Thank you, i see what may be wrong now. The stitches on that design is the same. It should rotate if I read correctly. I will pass this info off. Thank you, I think I might try this myself
