to make a long story short..I purchased the bmp from a women who said it was just to much machine for her in short..didn't have an interest so I purchased it from her..I paid for the shipping and insurance as well as the machine..It was delivered and due to the size of the machine I had to wait till my son-in-laws came over to get it out of the box and set it up..well upon setting it up I discovered broken and cracked parts all over the machine and immediately called the UPS service which delivered it..they came and took pictures of the machine and the packaging and even had to put the darn thing back in the box for another picture he needed..well the long and the short of it is that they denied the claim because they said it wasn't packed to UPS standards..The women took it to a UPS packing store and had them package the machine to make sure that it would arrive in good shape..UPS claims that the UPS packing store is not affiliated with UPS shipping and the sender would have to take it up with the UPS packing store..so here I sit out thousands of dollars and no machine..So beware of these packing stores they shipped this machine in a cardboard box..it should have been crated...and not in cardboard with packing peanuts...so for now I will continue to embroider on my small machines till I have enough money to pay for the repairs..

I am heartsick for you. I have a BMP8 and absolutely love it. Keep looking for an attorney. I will be praying for a speedy outcome for you. Don't give up and keep us updated. I wish you were near me so I could lend you my machine.

If you paid by credit card check with your credit card company to see if you have any recourse to cover damaged merchandise.

So sorry for your troubles
I would like to add..
That here in the Uk which also includes Ebay
(I know this as I have a shop on there.)
You are by law allowed to return an item
for a full refund as long as you lodge your return request with in 7 days of recieving the item.
This includes a varity of reasons, including change of mind.
its called the cooling of period here in the uk.
and part of the distance selling act.
and applies to any sales made via telephone, or internet
and unless you purchase an item directly in front of you
and take it home yourself this is the case.
there are some exemptions to this for instance
when you purchase from a mail order catalogue if you order a garment remove the tags then return it. the seller does have the right to inform you of your rights of not removing the tags
unless you are completely happy with the garment.
its just my thought that the seller had the responsibility of packing, although she paid somebody else to do it for her.. I would have returned the machine as received faulty.
Rather be out of pocket for the return postage
then the whole lot :-)

WOW! It's amazing how they claim everything is not affliated with one another now but they take the money for the services. I remember when I bought my serger and this seller lied to me about the parts and I saw that she was selling it on ebay as extras. I contacted her and she was standing her grounds. I was warm. However; I told the Lord about it in prayer and that same week I received a package from this lady stating, she wasn't able to sell it so she is sending it to me. God has a way of loosing what the enemy wants to gain from or keep. When people/business/etc. don't do right, do right don't come to them. I am believing that everything SHALL work out in your favor! Be BLESSED and let not your heart be troubled. God has a way of TURNING it around!!! *2U

Hi I wouldn't let them get away with that. The squeeky wheel gets the grease I say. Complain, complain, complain, to their bosses and the bosses boss. Does it say on the contract that it must be packed by them? If not, they HAVE to pay the claim. You bought the insurance. Fight it girl loudly and you WILL get results! Suzanne

(((BIG BEAR HUG))) to all my Cute family members out there..I have been sick over this matter and no one to talk to about it..I was afraid of posting this story but felt I needed to get it off my chest so I didn't feel like I was carrying the weight of the world on my shoulders..Just want to say thank you for all your comments and suggestions..things I didn't think about to resolve this have helped tremendously if needed..I have to remember that this is an inanimate object and not my health..that is what is keeping me somewhat sane...I love you all so much...thanks a GAzillion..

Oh heck no! You need to get legal council on this matter. I guarantee that a letter from a law firm to UPS would be all that's needed to ignite rectifying this situation. In addition, I would share this news with your local news station and newspapers.

I will seek legal advise if nothing happens in a week...Just gotta come up with the money unless I find an attorney who could do it and sue for his fees too..lol Funny thing is I was hoping to start making a few bucks extra with this machine as I have people waiting who want ball caps done..I am in a prime area for an embroidery business that would take off..and this machine was going to be my start...darn luck of mine...oh well they say things happen for a reason..just don't know what it is...

Talk to Shirlene... she had to go to court over her machine... she might be able to lend some advise and guide you on how everything was handled financially too.

I would most definitely call an attorney. You can google for your city consumer affairs advocates. Also I would contact the local TV station a lot of times they cover stories such as this and get a positive result.
If that packing store has the name UPS then it is a UPS store if UPS is saying it is not then they need to take action against that store for it using their name.
I would ask the seller to send you copies of the contract she had with the store and read the fine print to see if they have any disclaimers.
No matter who you get to help you, an attorney, consumer advocate or TV station all the paper work you can gather will help assist them in helping you.

The lady from whom I purchased this machine has been very good and trying to help me out in all of this mess..she has to wait for a letter of disclaim from UPS shipping before she can go to the UPS packing store to file a claim..sure hope they don't try and say we waited to long...so for now I wait..She will be the one refunded the money not me..Kinda sounds unfair considering she already got her money..but thank goodness she is an honest person so far..and yes I keep copies of everything and took pictures myself as well..even have the photo she sent me of the machine b4 she shipped it.

That is just disgraceful!!!
I agree with haydebug, you paid shipping insurance and UPS should be made to pay up, that's what THEIR insurance cover is for.

Do you have Ombudsmen like we have here in AUS? Or national Current Affairs tv programmes that highlight these type of wrong-doings, to ordinary people, by huge corporations?
Or national newspapers who like to take on these type of battles on behalf of the little person?

I had this happen to me with fragile items I bought from a lady on ebay, she shot everything into a soft, floppy cardboard carton, no packing beads, paper, bubble wrap, nothing, every single item was smashed to smithereens and was obviously caused by her total indifference to the packing because I won the items for such low prices.
All I could do was leave negative feedback and scathing it was.
But that experience was nothing in comparison to what you have suffered!
There MUST be some course of action you can take!!!
I would definitely seek legal advice for such an expensive loss. I hope you also took lots of photos and kept a copy of your payment for the machine and receipt for insurance coverage.

I truly hope you will get compensation for this.

Yes we do have a few that come to mind..I never thought of that..I just can't understand how they can reimburst her and not me...I have all my receipts..Sure hope this doesn't have to go that far..I will wait it out another week and then that is it..It has been a month now...I think I have been patient enough..

After reading your story, I feel so sick for you! There has to be something or someone you can contact for help. I can not believe the cost to repair will come out of your pocket. Don't you have an attorney friend you can talk too? Is the lady you bought it from going to file a claim for you agains the UPS packing store! What about the shipping insurance you paid for?? I am just sad you you!
