I JUST ASKED THIS QUESTION ON ONE OF THE CUTIES QUESTIONS.

I NEED HELP PLEASE! I BOUGHT DISNEY DESIGNS FROM E-BAY, ACTUALLY I BOUGHT 2 DISCS, ABOUT 2000 IN EACH ONE OF THEM, PAID BY PAYPAL AND RECEIVED ALL MY DESIGNS. I HAVE NOT TRYED THEM YET SO I CANNOT SAY THEY SEW OUT WELL OR NOT. WHAT DO I DO NOW? CAN I USE THEM OR DO I GET IN TOUCH WITH THE SELLER FIRST? SHE IS OFTEN ON E-BAY SELLING MORE OF THE SAME DISNEY DESIGNS.

I have a Brother 1500D machine and in the book of designs it states: The embroidery patterns which are programmed into this sewing machine are for personal, private use only. Any commercial or business use is strictly forbidden by copyright laws.

I am astounded that she is getting away with selling them on ebay. I know that Harley Davidson (which is also copyrighted) watch ebay for people selling there designs and have the power to stop the sale without even notifying the merchant. Disney is very strict with it's license. You can only ever legally obtain the designs by buying a brother machine and as previously mentioned you can not sell what you stitch them onto.

Don't need to look at the websites, if they have brand names and disney designs then they are selling copyrighted designs and they have been stolen, unless under the design they state that they have a license to sell that design.

CuteGirl, just DO NOT BUY Disney designs unless you have the Brother Disney machine. Brother's are the only legal ones there are in the USA, there is no question about that. Everyone else's are not licensed, therefore STOLEN. I suppose you could technically be charged with "receiving stolen goods".

Brother is the only one allowed to sell Disney designs and even those are for personal use only. You may not put them on items for sale.

Just got to thinking about buying patterns and copyright. I have bought over the years many Amazing Design cards and love their patterns but one thing I found if you don't read on the outside you won't know if you can sell them or not. Since I do many craft shows and the Farmers Market to sell my embroidery I will only but designs I can sell. I understand Disney haveing copyright on theirs along with other cartoon ones but think Amazing Designs should let you sell what they buy. JMHO. If I'm going to give almost $75.00 for a card I want to be able to sell them. Be sure when you buy any designs if you wish to sell them read the labels before you buy or you will have something that isn't worth it unless you want them for yourself. I learned my lesson when I bought one for $75.00 non returnable and can't sell them. Never used that card. :( Happy stitching everyone. Always know what you are buying.

Thanks! Laurel Burch designs same way, can't use on items for sale, can't use each design more than 5 times. You have to READ the whole terms & conditions, ladies!

She most likely is illegal in selling them. With Disney even if you have a Disney Machine you can use them for yourself, give as a gift but never sell them. Even if you buy Disney from Brother site you cannot sell them. They are for your own private use and never to sell. They did tell me I could give as a gift to a friend. I'd never try selling them. Just be careful.

i have also Disney designs but i use Brother machines so the designs are in my machine
and i have buy in the emb store special brother cards long ago

They are probably illegal, most certainly.. A Disney license would be very costly, if one could even be obtained, which I doubt.
I do think that if you were to use these designs for your personal use,,,no gifts, or selling of the items, you may be ok. But for next time,,if something you know must be a licensed design is being sold for a "reasonable" price (lets say inexpensive) it is probably illegal. Protect yourself from any problems and don't buy.

I too find this quandry mind boggling. Disney has sold designs with machines, andI think a person has the right to sell that set separate. This may or may not be the case, and I may be off base, however personal use may be OK. Are they in the States?Live Laugh Download Stitch! christine

You can not sell these designs, or anything you put them on. They are for your personal use only (says so in the info with the designs and machines)...unfair, yes probably, but they have big lawyers to fight you on this issue.

I bought the Brother 190D especially for the Disney designs, only to find out in the fine print you can not sell any items embroidered with the designs; they are strictly for personal use only. Dealer did not tell me that at the time. The machine is a pretty workhorse that's worth it's money, but I would not have bought it if I had know!
And there's no way you can sell the designs themselves!

Copyright & license different. Disney holds the copyright, Brother is licensed to digitize Disney designs in USA, possibly worldwide, but that I don't know for SURE.

The dealer who gave me my Brother 750D machine made my swear I would not sell items with the Disney designs embroidered on them.

He was adamant that unless I verbally agreed to the conditions then I could not have the machine.
