Sllakin asked if there was a heart shaped ITH purse design with a diagonal zip. It seems that there isn't, although there is a pattern available for one to be made on a sewing machine. If I digitise one am I contravening the copyright laws?

I do have a pattern, it was a free design from Brother , i do not know if I can poast it here. Is it possible? I have the tuturial with the Brand of Brother too. What should I do?

Does it have a diagonal zipper? I searched Brother and could not find it. Do you know how big it is?

If you break it down into parts -- no.
The heart shape is too common.
The diagonal zip is trendy but also common.
If you do your own artwork and your own digitizing -- a quick search on the internet showed no other ITH so I say be the trendsetter. You already have another shape done, finish the set. Do all the shapes or add outside pocket(s) for a phone or ...just do not a "Taggies" to it because they are protected. Can't wait to see what you do.

The little blankets/toys/balls etc. with the ribbons around the edges. Somebody at the Patent office let them claim rights to sewing any looped ribbon between any 2 pieces of any 2 fabrics.
Google search Taggie and click on images. A lot of people do make them -- but any who sell them (or even make them) run a huge risk of being sued. They are very aggressive.

I have seen soft toys and blankies made by several commercial brands, some of them in business since before the flood. How can they get a patent for that?!

I was shocked when I read about it. The key points are the ribbon sandwiched between fabric and made for children to play with it.
One of my friends had the same idea after watching her child make a hole in the satin edge of his blanket. He loved playing with that hole. So, she made some for him and some to sell. She sells stuff on Etsy and when she put those up, they took them down and sent her the legal info. I do not know who would allow such a broad patent. They must have never sewn a stitch in their lives!

I guess the same could be said for a round zippered purse, or a square zippered purse or an oval zippered purse...would one be contravening copyright laws there? Or, lets say a stuffed bear or bunny or any other animal that has a sewing pattern or...seems like lots of digitizers have digitized their versions of these stuffed animals...and what if you did digitize the heart purse and then someone out there in this great grand world found another one that had already been done??? I, too would like to hear more from other Cuties...
