a service order for it, even though - I had purchased the machine from him in High Point, NC and it was still under the 1st year of warrenty - he had serviced in before and never written a service order - well - to make a long story short - he KEPT my embroidery machine - I have been fighting him in court for the last two and 1/2 years - I even bought another Babylock Ellegante2 Embroidery Machine, but from another dealer. I flew to North Carolina - which is across the country for me now - in February for the court case - today I found out that the court has ordered him to pay me for the Babylock Ellegante Embroidery Machine, plus some damages. YIPPEE! He can of coarse appeal the case, but it will not do him any good to do so, but he will delay it, so that he doesn't have to pay, I know this man, very well. But this will not hender me any, as I see it - I WON!!!!!!!! Can you believe that????

Wow, congrats, Shirlene!! And yes, report him to the BBB and anyone else you can think of, call the local paper and have them write a story about the case. These kind of people should be shown up for what they are, to protect others from going thru the same ordeal. I can't imagine him thinking he could get away with keeping your machine, but what a terrible hassle to get your rights in this one. I'm so glad you're on the winning end of the deal!! Love, Marji

Marji, I don't know - about the paper - I don't live in NC any more - but I have thought about calling the BBB - over the last couple years - I did want to take an ad out in the newspaper - when this first started - I never did tell any of the other ladies from my embroidery club - why I stopped going into the store - but I did want to - then we moved - across the country - I appreciate you support and your thoughts - I do feel good - I don't have closure, yet - but I will - if the courts can make him pay. thank you - *4U

You go girl! I am so happy that you won. Do you still have friends in quilt clubs, etc., from NC. Let them know what happened, and that YOU WON. But be careful how you tell them. You don't want to have any slander (although it won't be, because he deserves negative press) charges against you. Since he kept your machine, I wouldn't put anything past him.

GG, thank you and the slander thing is part of the reason - that I just left the classes and didn't say anything to them - I didn't want a case against me - before I had my day in court - I would like to tell them - but feel that I would have to wait - until I had the money - more than anything - but he didn't just keep that machine - he sold it to another person. *4U

Glad to hear that you finally got through the court. Hope he will finally pay up. And you DEFINITELY should tell the BBB so others don't get the same treatment. Just send them a copy of the court ruling, it should give them what they need to know. Also your embroidery group - the court record is public information so you can't be accused of anything but making him madder than he already is (LOL) and they deserve to be warned about him! OH thank you Lois - that does give me courage to think about it - I do think that others need to know - what he did - he is a very evil man and does much more than what he did to me - I have watched some and didn't say anything to others - hoping that I would get my day in court and I did and WON - thanks - I surely will take this to heart, too. *4U

Thanks Meg, I did get the cost of the machine and damages - the lawyer will get his fees and I will let you know about the hex - if needed. Hehehe! The expenses were part of the damages, I guess. *4U

WOW! Good for you for keeping on top of everything and not giving up, like I'm sure he would've hoped you'd do.....especially since you now live across the country. Thank you and to say this was a fight is very right - all this time - not knowing whether my lawyer understood the reasons to fight for a machine such as this and then to find out - he was listening and put together an unbelievable defense - it was hard to deal with the time frame - but now - I know - it was so worth the effort. *4U

we also have the CCB we have to report to...I am bot sure if he has a state registeration like Oregon, but all conflicts are dealt through them. The BBB does file things, but a they don't go after licenses as hard as our CCB...

Shirlene, I admire you for hanging in there and fighting for what was right! He is no doubt a crook and should have to pay for what he tried to do to you. The bad part is that you have had the worry and the wait of all this time, not to forget about your money just being gone! He should not be allowed to have a business if he is so dishonest! Wow! Unbelieveable - that someone running a business could be so dishonest! I am glad that you followed through and hopefully will get justice - your money for the machine and your costs. I will make sure that I get a receipt if I take my machine in for servicing.

What a story! It just goes to show how people you would assume are ethical business operators can be crooks! I'm so happy to read the justice system was on your side. For you it was a win-win. Is this dealer still in business? Certainly a heads up for anyone in High Point, NC not to purchase a machine from this dishonest person. 4evertwa, thank you very much - I am happy - it ended in my favor, as I always knew it would - I had alot of things to show that I owned that machine and people that knew I took it in for repairs, too. Maybe he will decide to pay you rather than spend any more money on legal fees. Does Babylock know about his un-ethical behavior? I'm sure they would not what to be associated with such a dealership.

Mary, thank you - oh the idea of a speedier case was what I wanted - I never thought that it would go past my lawyer contacting him - actually - I never thought that it would end up in court and him putting the system into a couple year case, either. *4U

Great news. Good on you for pursuing the matter, so many (probably me included) would just let the dealer get away with it because they either don't know how to push for resolution, or aren't strong enough to. Many sewers are elderly and wouldn't be able to take this sort of action. Hopefully the dealer won't try another fast one on anyone else and your efforts will have been well worth it.

Marg, you have no idea how many times this man had serviced two of my machines - without service orders - but to have him do this to me - a very good and loyal customer - I was shocked to no end - but I wasn't going to allow him to get away with it - either. Thanks for your support.

That is fantastic news Shirlene. I feel the same if I know I am right, I will put up a fight and take them to court, does not matter who it is, or how long it takes.(The last person I took to court was a doctor for an amount of +- R10000-00 and I won).

I do thank each of you for your support and comments - I have had a really busy day and couldn't get back until now - but I wanted to tell you all - I appreciate you and always keep very good records of your purchases and service on your machine's - you never know - when you might need them - I had pictures of my machine, alone and with my grands - also at a friends house - but I didn't have the SS# of it. Not that it mattered in this rulling - but it could have - as this man also sold my machine to another person and from that I could have gotten him on other charges - but without it - I couldn't go down that road. My newer machine - I have all the info on it - not that I ever think that I will need them - but I did learn a thing or two - I hadn't had any of that on either of the machine's that I did purchase from this man - so there fore - when I tried to contact Babylock - they would not listen to me - as I didn't have a SS# and they would not step in without it. I just want you each to realize that you have rights and you need to stand up for yourself when those rights have been stepped on. Unconditional Love, Shirlene
