if the site has a license to use it or a copyright or whatever else it is called because I'm not even sure where to look for this informatiom on the site? I just want to know if I can use it for me? If not then why can they offer it as a free design?

Any trademark designs are suppose to be purchased and cannot be used to sell for profit...However if you have a Brother machine, they usually come with Disney designs and you are able to use them for yourself and family as gifts not for sale...
Outside the US, alot of sites use trademarks but it is still against the law to sell a trademark design. They are not legal to downlaod because of this...

that's good to know thank you for such a quick response! My friend has bought a brother machine & she has some winnie the pooh & tinkerbell sew I wanted to make sure first!
I don't think you are even supposed to use your friends designs. Only the person who purchased any design has the right to use it.
There was a discussion a while back in a yahoo group about our Brother machines with embedded Disney designs and how they are only licensed to the original purchaser - does this mean our machine must be returned to Brother when we pass over? Makes your head spin, eh?

The only one offering Disney designs is Brother and as far as I know they do not offer free designs. If a site other than Brother is offering it, they are infringing on the copyright and actually stole the design. I for one will not download a Brother design or other design that I know is copyrighted as they could also come after me for money.

If the design came from a website owner or digitizer from the website that has actually paid Disney for a license to be able to digitize the design and sell it to the public then you could.
But just because a website has a copyright statement on their website does not mean they have leagally purchased licenses from the creators/artists of the actual art work to use the art work for digitzing purposes.
Having said that it is highly unlikely that any Disney Designs you see on websites are legal. So that means you should not download or use them for your personal use or to stitch on articles and sell the articles to the public. If you did you would be breaking copyright laws.
The only vendor that I know of that sells Disney Designs legally is Brother and they sell the designs as sets.
Disney Designs are copyrighted and probably trademarked by Disney and any licenses they sell would be way too expensive for most individual digitzers to purchase.
Also Disney produces their own articles with their designs on them and their copyright is there to protect the quality of the articles that are sold to the public with their designs.
So No would be your answer!

What a can of worms! With us having access to the entire planet we get things that we can't get here. Our copyright laws are very strong, and they should be. A Disney design is just like any other, only worse. You not only have the person who digitized it to worry about, but Disney. They will come down on you like a ton of bricks. And you're just not supposed to use them, period, for anything. But, gosh, do you really think they have people out there watching for embroidered designs on your shirt? And then that they are going to grab you? I have done a few for my greats. But no way would I ever do one for anybody else, even my best friends. Or to sell. NOT going to happen. Now, do I download them? You betya I do. I love Disney stuff. And I do believe that Brother is the only company/person who has a license to do their designs. If you buy them from Brother, they're legal. And you can do what you want with them. Well, except resell the designs. <br /><br />(Boy for a newbie, I'm saying a lot!)

Technically, no. I have Disney designs embedded in my embroidery machine, but I'm still never allowed to sell anything I make using those designs. Its a big selling point for the Brother machines but its not till you get it home and read the manuals that you realise you can never sell anything embroidered with those designs. I mentioned this next time I was at the dealer's and she said that Disney have spies everywhere and they have no problem taking down the little home embroiderer. Sure put the frights into me, I've only ever used the Pooh Bear designs on my son's nappies and a couple of test swatches I did when I first got the machine. Shame really.

I was thinking about buying one of those Disney-brother-machines but I read that the designs are only for your personal use. You can even get in trouble if you sell your own kids stuff second hand on Ebay (better do it on the flew-market next to your home). I love turquoise but often wondered that she still can offer her designs (she has so many nice H-Kittys). For the attorneys from Disney or Sanrio it makes no difference if you sell them (like this one website from Russia, you know which one I talking about ;o) or if you didn't earn money and give them as a freebie. In Germany it is allowed that you digitize those designs for your own personal use but you are not allowed to offer them to others (not for money or as freebie).
That's why some of the designs at DBC are deleted suddenly; some newbies upload them and didn't know that he/she is not allowed to use a design without permission/license of the creator. With "famous"designs (everbody recognitioned them) I'm allways wary...

I believe it is because many Brother embroidery machines, particularly the single-needle ones, are sold for home use, i.e., stuff for friends, kids, grandkids, etc., but not as a home-based business. The home (or hobbyist) machines are not fast or efficient enough to produce the level of goods necessary for a successful business.
I have an industrial machine (more needles/less money than the 10-needle Brother) and it came with a ton of designs, mainly from Dakota Collectibles, but even those are pretty generic and nothing that has been licensed. I get inquiries about doing sports logos quite often and I just tell potential clients that I cannot do anything licensed as I don't wish to tangle with anyone's legal department. As for making stuff for personal use, that you can do to your heart's content. Whenever I find a new embroidery design site, the first two things I look for are whether they have the format I need and what is there use policy on selling goods with their digitized designs on them. If there are limits, I look elsewhere.

Looks like you have your answer. What I would like to know is, since Brother is the only legal company licensed to sell Disney designs and Disney is so tuff on cracking down, then how are these illegal sites still up and running for so long? Where are the design police when you need them? I would never get close to those sites for fear and honesty. Not worth it.
