I think the answer would be "yes".

I also think the answer would be "Yes you are" but if you are only using it for items in your own home and you wouldnt be selling the stuff would that still be unacceptable??????

Good question. My thoughts...... Do it. Sure wouldn't try to sell any of them, but to do for your self? Who's going to squeal on you? I know, I'm bad, but I'm so good at it.

The key words are "for own use". Yes you can digitize them - it would be the same as if you hand stitched them. You would not be able to sell, give away, or share your digitized designs - because the designs hold the copyright. But you can put the designs on things for yourself and to give as gifts.

Why not contact the original designer for permission, due to your physical ability? Can't hurt!

You have purchased the pattern from the designer, so you may sew it however you see fit. If you choose to sew it by digitizing it and letting your machine do it because your hands are bad, no problem. BUT you cannot give away or share the digitised design, or sell the digitized file. You purchased it for YOUR use, and that's where the pattern has to stay, with YOU. If you want to give away articles made with the pattern on your machine, it would be the same as giving away an article made with the hand stitching. Same holds true for selling articles. If you're allowed to sell articles with the hand-stitched design per terms of the pattern, then same for the machine-stitched design. But your digitized version of the pattern never goes beyond your machine, that would most certainly violate the copyright, that would infringe on the pattern-writer's choice to sell (license) that pattern to a digitizer for resale as a digital file, and the owner of the pattern would charge much more for that kind of license than the few dollars charged for a pattern book.
